Wrap around Mortgage

I am in North Carolina and I will be doing a wrap around mortgage and then selling on land contract. What documents do I and the seller need to complete besides the general warranty deed. Do I need a deed of trust and should it be recorded?

since youre doing a AITD/wraparound, how is the homeowner on the underlying mortgage going to handle the foreclosure process if your buyer defaults and claims bankruptcy?

Yes you need to give them a Deed of Trust so they can have a recourse in case you default on the loan like defcon said. You need

Promisary Note
Power of Attorney
Authorization to Release Information (recommended)
Disclosures (HIGHLY RECOMMENDED).

Did you do title search? make sure to do a title search as well. I had a guy try to sell me a house he did not own… he thought owner financing is like renting and he could just resell it to someone else :slight_smile:

If you have an all inclusive deed of trust, would you still get a warranty deed? In deed of trust states, I believe I have only gotten a deed when I did not use financing, otherwise, I only got a deed of trust.
