Will a realtor profit even if they didn't participate in the short sale?

My client listed her home with a realtor at the end of March 2008 but the realtor has shown no interest in helping her sell the property due to the value of the property and not wanting to deal with the short sale process.

She has contacted me about doing a short sale for her property; since the realtor has shown no interest in helping her sell her home, will the realtor still be paid by the bank if a short sale is executed?

Is this fair?

As long as the realtor has the active listing on the market, the realtor is due the said commission on the listing agreement.

Don’t get involved unless the homeowner has the realtor withdraw the listing. Have her call the broker and file a complaint stating she wants the listing removed. Only then should you get involved, otherwise you have no contract protecting you for the work that you put into it.
