Wholesale before Chapter 7

Hello everyone I have a problem & just trying to see If I can do a whole sale myself on my own property ? In order to bring my mortgage current I owe $19,2456 the balance on my mortgage $134,27026 my appraissal last year was $160.000 but I know If I sell It to some one they can call for a payoff less then what I owe ? I would appreciate someone sharing a little Enlightment on this small situation I have before march 7 & this Is when I go In front of the creditors & trustee / any options ?

Are you currently in bankruptcy?

I filed for 7 about two or three weeks ago thats about It Im just waiting for the creditors & trustee hearing then I guess the rest would be up to the judge ?

I suspect you’ll have to wait for meeting. The trustee’s job is to make sure your debts get paid. What does your attorney advise? Have you gone through debt counseling?

                 I dont have a lawyer but i do have a parallegal that helped me with all my filing papers & she Is very helpfull with some Info giving me some heads up on what to watch out for but thats all she can do .

I just want to know If I can sell the property at a certain price like maybe $145,000 and still use this appraisal from last year to my advantage as leverage even though the market Is down?

You really need representation as the new BK law is creditor friendly and you need someone to navigate you through the process. I don’t think you should do anything until that meeting.

I am also new to this forum - but just went through chapter 7 w/o lawyer. It has been discharged.
My fault was listing the house to re-affirm on the bankruptcy. We cannot afford it. You will have “bought some time” with the bankruptcy. We have not paid (except for one payment) since June 2007 on 2 mortgages.
I agree, wait for meeting of creditors.
In Florida, homestead is excempt if you lived there as primary residence for 3 years or more.
Just voicing from my current experience!
