I have read that your state records the notice of pre foreclosure. Who do I call to find this information? I tried the registry of deeds, but they told me that they didn’t record that info there.
Hey,
It depends whether your state is a judicial or non-judicial (or both) state. Texas, for example, is a non-judicial state meaning that the lender simply goes to the county clerk and files a foreclosure notice (trustee sale notice) and 21 days later, thereabouts, the property goes to sale. In judicial states the lender files a lis pendens at the court clerks office stating that legal action is forthcoming on the property. This is true pre-foreclosure. Find out what it is for your state and then somebody in your county offices should be willing to help you out finding what you need to know.
Peace,
Richard
