I have a rental that I am going to remodel and move into this summer. I anticipate starting construction June 1. This tenant is in a lease that goes through March 1. I intend to let him stay as long as possible, and let the lease go month to month. I think I need to notify him before the lease is up - at least 30 days?
I guess if he moves out he moves out, but I’d like him to stay as long as possible for obvious reasons. Is there any reason to notify him before or after the lease expires?
Don't send any notice until "May First" as your current lease automatically goes month to month under the same conditions as the original lease when it expires, and you may present the 30 day notice to vacate on May 1, giving the tenant 30 days to get out.
The lease expiring has no bearing on when you would like them to leave!
If the lease says that it automatically reverts to a month to month at the end of the year, you do nothing but allow it to convert.
If the lease says that it automatically renews, then thirty days (or 60 days, what does the lease say?) before the lease expires, you send a written notice that the lease will be expiring and that the rental agreement is going to continue as a month to month agreement.
Then, 30 days before you want the house, you give a 30 day notice to vacate. (or whatever is required by your state law)
If you must notify them that the lease is expiring, and you really want them to stay, send a written notice that the lease is going month to month and you are dropping the rent by $25. It’s only a couple of months, so you won’t lose much.
The down side to notifying the tenant that the lease is expiring, is that it reminds them to consider moving. But you are going to have to notify them if the lease is written so that it automatically renews.
I like this post because this have all that was required to told .I also thinks that there should not be any problem if your lease agreement will change in month to month rent. but if your lease agreement needs to be renewed to go month to month later then inform about that to tenant and let him know that you want to keep him.
Thanks for the advice. My question was about allowing the lease to go month to month - whether it changed the requirements about not renewing the monthly lease. I’ll give him a notice that I won’t be renewing the lease and it will be going month to month, and give him notice probably around March or April. I can start construction a little bit early if he moves out, or he has more notice. Not a big deal either way. He’s been a decent tenant.
