What To Do When Owner Dies And In Foreclosure

Any suggestions on what to do when the owner dies, with no will? House is in owner’s name and not in probate yet. The husband can’t afford a probate attorney. Is there a way for him to get the deed or the ability to convey the deed? Or does he have to let it go to probate and miss the foreclosure auction?


I just had one of these. I had the granddaughter take all the information of proof of relationship directly to the Probate office at the courthouse. They walked her through putting in the request for title transfer to present to the judge.

They also put in an immediate request for the judge to stop the auction until title transfer takes place. This stopped the auction and we sent all the info to the settlement office to begin process so that when the transfer came through we went to settlement before they could start the auction again.
