We recently changed our partnership into an LLC, and we wanted to move one of the properties into it just before we sold it (my partner had purchased it in his name oringinally). I called the Title Agent and told her he wanted to QCD to the LLC, and sure enough she gave me the typical, that won’t work, that is a problem, it needs to be a warranty deed response.
I didn’t argue it because I didn’t want to cause anymore delay than we already had on that property, but I don’t understand what the issue is; I have wintessed this same repsonse from title companies and mortgage lenders in the past regarding QCD’s. I know for a fact QCD is valid title transfer, but why do the title companies and montgage companies nevertheless try so hard to disuade the use of them?
