What if seller wants to use their own contract?

I am a new wholesaler looking for properties to assign to my investors, my question is…

What do you guys do when the seller wants to use a contract they have instead of using my contract? do I insist on using mine?

Even though some sellers are motivated, doesn’t mean they aren’t smart…what do I do in this situation?

You are making the offer. You write it up, on your forms.

i’m with steve on this one. however, find out why the seller is insisting on using their own forms.

get information.

don’t say, “hey why do you insist on using…”

say, “I’m really curious about something. I was wondering if you’d tell me about your contract…”

if you’re assigning the property - does the seller understand what you plan to do? you said something about a seller being smart…if you’re trying to get them to sign a contract with you “as nominee”, then they should understand that before they sign. whether you sign their contract or your own. i presume that even if you have to use their contract - that you will of course make alterations to it.

i would say that’s your second option. just use theirs and make necessary changes to it when you sign it. then they’ll review your changes accordingly.

what about binders prior to contract - work out some kinks there - at least get the ball rolling.
