Ok to begin with i live in Texas. I have a question about buying a property on the courthouse steps at the foreclosure auction. In Texas after a forclosure sell the owner has no right to redemption. But Texas is a community property state. My question is if the loan that is getting foreclosed on was made while the individual was single and they got married sometime after what rights does the spouse who is not on the loan have? I would assume that even though they are not on the loan they would have a intrest in the property.
