Tenants bailed on lease a month early, what to do?

Lease was through March 31st but they ‘thought’ it was to expire March 1st and signed a new lease with another landlord. They moved out and he called to say that the keys and garage remotes are inside on the kitchen counter. I took a deposit equal to one month’s rent and I assume he’s planning on me using that for the last month’s rent. Should I just let them slide or get them for late fees, surrender of deposit (as per lease terms) and final month’s rent in court? They were jerks the entire time to me so I almost want to put forth the extra effort to getting every penny out of them I can. Just curious what you guys/gals think. It should be noted that BK might be in my not-so-distant future so this is kind of a big deal as things are already tight financially.

The key thing is getting the property back up and rented as fast as possible. If they left the house in rentable condition I would just keep their deposit and move on. If you go to court to get an eviction to put on their record plus fees and court costs. You can do that as an after thought because they will not pay you. But maybe one day they may want to get financed on something and they may come back to you to get the judgment removed and pay you off. But the first thing is to get the house back up in a week or two and rented by the time the next mortgage payment is due.

I agree with Bluemoon…If they didn’t trash the place, count your bleesings, take a deep cleansing breath, and let it go.

That makes a lot of sense to me as well. You have to weigh the advantages of legal fees for what you will get back, especially if you have the last month’s rent in hand. What condition was the place in?

Now that they are out, you can get it rented, hopefully to someone who can read a contract. :biggrin
