Depends. If one spouse has high liability (e.g. works as an obstetrician, etc.), that spouse is likely better off not being a member of the LLC. Also, depending on the state of the marriage, there may be significant family law/divorce issues - those issues are state specific and not something I’m qualified to opine on, as I am not a divorce specialist. In general, there’s little harm in having the spouse on the LLC, and perhaps a small benefit if creditors of one spouse come looking for payment from an LLC with both spouses owning an interest, at least in those states that recognize each spouse as a truly separate person (i.e., not CA).
