Have a probate. Daughter is the executor. Brother is nothing, but he moved a friend into the home. Brother went to jail friend is still living there and won’t move out. She wants to sell. How do I/she get this guy out? I live in PA.

I had the same type of problem with a squatter who had no legal basis. He went to work in the morning at the local gas station, so we went to work and loaded his stuff into a junk trailer he used to move in with and delivered it to his job that afternoon. Problem solved.

From your post, it would appear that there’s no contract/written agreement…if this is the case, then it’s time for “Uncle Nunzio” or another ‘crooked nose’ of your/her choosing!

i would check with an attorney because this is not a typical squatter. the person was initially a real tenant, therefore you may need to evict him formally. verbal leases are still leases and considering that the guy has stayed there awhile, he may be able to prove that he was allowed to stay there legally.
i could be totally, totally wrong, therefore check with an attorney. :deal if you happen upon the wrong person that knows the law and you improperly evict them, it could cost you.
Someone told me a story about a landlord that improperly evicted a tenant by changing the locks and entering the tenant’s apartment without notice. That landlord ended up paying the tenant and because they were just starting out and didn’t have any reserves, they ended up selling their building to pay the tenant.

It would be better to go to him and offer to pay for a week or two in a motel. Most people like him would rather be in one anyways. And it is only a couple hundred bucks to keep from getting a headache.

Give the guy a three day notice to vacate. After the three days, go to court and file a Forcible Detainer for about $60. They will set a court date in the near future, and the judge will give him five days to move (whether he shows or not) . When the five days is up, and if he has not left the house, file a Writ of Possession. The court will post a note on the door, saying he has 24 hours to vacate the home. You meet the constable the next day at the home, along with friends, and strong trash bags. You throw all of his things in trash bags, while the constable watches. You take all of his furniture and full trash bags out to the curb. You must leave it there for 24 hours. As soon as you get everything on the curb, you then change the locks.=) In the mean time, people pretty clean up the mess for you. Thats how it works in Texas, anyway=)
