Should Mom be Guaranty or Tenant?

Hello,

First time landlord-to-be here. Found a potentail tenant. A guy and expecting girlfriend (she doesn’t work) will live in the house. The guy’s mom is going to pay the rent. The couple are over 18.

We think the guy and the girlfriend would fill in the application and sign the lease as tenants. and the mom will be the guaranty for the rent payment, but not a tenant.

Is this right? we’re in TX.

You should make all 3 tennants on the contract and all 3 liable for the rent. More people liable, more people you can go after when they stop paying or do damage to the property

Your contract should make sure all parties are fully responsible for all costs associated with the contract…Not an equal share.
