selling a rental

I am thinking of selling a rental home and I currently have it rented unti Feb.2007.If I sell what happens to the tenents? I live in Florida and I am a little fuzzy on my rights to sell under this condition.

In many states, if the tenant(s) has a standing lease, the new owner must honor it until the end of the lease if the tenant(s) so choses. If the tenant(s) is on a month-to-month, you just give them proper notice to non-renew.

What I’ve done is draft up an identical lease to the one already used by the tenants in the unit, I explained the situation to them, assured them that they were in no jeopardy and that I would not sell without the buyer agreeing to keep these tenants on, and had them resign it – lease termination date and all other information was the same. Then, at closing and before signing the paperwork for the sale, I asked the buyers to countersign the lease as well. That way, regardless of what the law says, the tenants have a new lease with the new owner’s names on it and can feel comfortable that they are locked in. As long as you are up front with both your tenants and any prospective buyers, I’ve never had a problem.
