Sale agreements

I am curious to the results of the poll…I have always wondered what everyone was using to make their deals.

Well, this is what I did.

I bought agreements from the store for 1$
I took agreements from the Internet.
I took Real Estate agent agreements.
I went to my lawyer.

We hacked all the agreements apart and essentially just added the very good addendums together and made 1 agreement.

Lately though for my all cash offers I’ve been way too lazy and have just used those 1$ bought from the store agreements, probably not something you should do, but it works nonetheless.

I’m something like Tein above:

Started with the standard local Realtor Agreement

Modified it here and there slightly for my benefit, such as who pays what settlement costs, what exception clauses to include/exclude/waive, timeframes for inspections, etc

Modified more as experience dictates and I learn more

I now use two separate Agreements, one when I’m buying, and one when I’m selling. Each is tailored for my benefit in that particular situation.

It depends if I am buying or selling and from whom.

If I am buying from a Realtor I use a Realtors agreement. If I am buying on my own I use an agreement that has evolved over the years from all my negative experiences. This is definitely tilted in my favor.

If I am selling on the MLS I use a Realtors contract with lots of addendums. I I am selling with out a Realtor I use my selling contract which is totally tilted toward me.

I guess the contract is dependent on the deal and how I want it to be structured and how much latitude I feel that I have in the deal.

The Lawyer “thing” is good to CYA…
