I was told to make sure I had this in my lease in order to skip the process of waiting 30 days before I start the court process to evict someone. Does anyone use this wavier in there lease if so exactly how should it be stated in the lease?
Unless your state recognizes this waiver, you’re going to have to give the proper notice and follow the same procedures as are written in your state’s code. What does your state’s LL/tenant law state?
Where I am, I can give a 72 hour notice when they’re late on the rent. As long as I file by Wed. at 12pm I can be in court the following Monday. When the judge hears they owe me money, I get an order for them to be out the following Monday by 5pm.
Waivers are for the pay or quit notice, not a quit notice and that assumes state law doesn’t forbid waivers.
