quick claim deed/ laws/ protection

Hello Rei,
Something I ran into.I found a beautiful home in my price range with a VERY good resale price down the road if I wanted to sale.My real estate agent tells me my soon to be abusing xhusband will need to sign a quick claim deed in order NOT to be half own in this home.My question is : Out of spite what if he wont sign? Are there any laws about this? What would I need to do in a case like this to have my own home?

if your buying a house not selling it, it shouldn’t require him to sign anything, but each state has its own divorce laws, talk to your divorce attorney before you do anything

selling a house while your still married or taking cash out of a house, even if the house is your own separate property,that gets messy and does require the estranged spouse to sign (been there done that)

If you’re about to be in a divorce, then I’m surprised the agent hasn’t told you to NOT buy until the divorce is final…wait…oh yeah…commission…
States are all different, but in TX we are community property, so what’s hers is hers and what’s his is hers…er…well, anyway, the property can be claimed by both, so if someone is going thru a divorce, and buys a house, the soon to be ex can claim it as community property, and it gets tossed into the ring.
So, like AJ said, contact your attorney BEFORE you buy.
