I live in CA and I have a question about contracts/purchase agreements. If I were to send a seller a purchase agreement, I would fill out a contract, sign it, and then send it to the seller so they can sign it and officiate the contract.
Now, if the seller sees something they dont like in the contract can they just cross it out and then sign the contract? Is this legal?
I understand that proper procedure is for a seller to sign the purchase agreement subject to a counter offer if there is anything they want to change in the agreement. Then they would send the counter offer back to me, the buyer, and if I agreed with it, I would sign it and be done, or I would sign it subject to another counter offer letter and so on.
I’m just wondering if a seller can alter a purchase agreement before signing it and, since the buyers signature is already on the document, have the contract in its altered form hold up.
