Hello all. I’ll get straight to my question. I am trying to find out if there is a way to find out if a property that has been taken back by the lien holder has any code violations, physical damage, etc., or has any kind of violations at all filed against it. I’m asking because I recently visited the courthouse in my county and while looking at trustee’s deeds, I didn’t see any additional notices about the property. I need some guidance with this problem and I don’t know if there is a short cut way to find out this information or not. Thanks all.
it sounds you would like to know if seller’s disclosures are required by entities like banks when they foreclose. in the state of texas they are not required to fill out a seller’s disclosure, neither is a bancruptcy trustee. even when seller disclosures are part of a contract they are only as good as the memory, knowledge, or integrity of the seller filling them out.
I am in MO. and as of right now I’m not aware if such a disclosure is required by the state, or by any particular lien holder. From speaking with someone at city hall recently, I would have to call and inquire about each property individually and that would take a considerable amout of time to do. It just seems like there would be some type of database or something that I could find that would spell out any violations if any. Is a sellers disclosure the only document that would be filed that will list all of the issues with a property? It sucks that such a form is not required. The courthouses in my county don’t list any type of additional forms or additional links to see information like that. What procedure do you use to find out what the state of the property is that has been taken back by the lien holder? (I know drive bys would be the norm but are there any alternatives?)
