How do we split the write offs? We split everything down the middle, but The mortgage and deed are in his name.

You call him a partner. You have a partnership. even if there’s nothing in writing stating that.

I will digress here to suggest that you put it all in writing. asap.

file a partnership return for all rental revenues and costs. each partner gets a K-1 for whatever % that passes through to your 1040.

doesn’t matter whose name the mortgage is in, although you shoud document exactly which 1098 goes with the partnership and not him personally.
