Newbie Question

If I put a property under contract using an option to purchase agreement, can the seller sell the property to someone without the new buyer buying me out of my option agreement?

Have you recorded your option?

Would it be better for ME if I get it recorded right away, then can the seller not sell it to anyone else without my permission or consent?

    Not supposed to sell it. But could try.Being as you have filed a "notice of option" with the county where the house is and the Title Company handling the sneaky sale will have to contact you to discuss your option. At that point you could sell the option back to the owner or the buyer, or force the sale to be canceled for you to purchase.

What do you do to “record the option”? Where do you take your paperwork to be filed? Do you need to contact a lawyer?

Go to the county in which the home is located in with a copy of your option paper work, :deal The actual agreement . Give it to the county clerk, he will charge you a filing fee and give you a reciept for the fee and transaction. All done.
Find another lease/op, repeat above, fill w/TB.

From what I understand if you have a signed lease agreement and a signed purchase option agreement , The seller Cannot sell the property to anyone else until the time that the lease option is to be executed or declined.
