I need a lawyer in NJ who understands land trusts. I have both a trust agreement and warranty deed to trustee which I need an attorney to look over and give me advice about any changes that need to be made or if anything should be added. In my effort to find someone to help me, I have talked to two different NJ lawyers and I honestly don’t think they are giving me good advice. Although I am new to real estate investing, I learned from Ron Legrand’s courses that transferring into a land trust does not trigger the due on sale clause. However, both the attorneys I spoke to told me that transferring title to a trust is a technical default and triggers the acceleration clause of a mortgage. So if anyone doing business in NJ can refer an attorney familiar with land trusts, please let me know. It would be much appreciated.
