I own a home In Vallejo, CA and I have tenants living there now, but they are moving out without paying this month’s rent. The reason they are moving out is because I am putting the house up for sale. They signed a one year lease, but they will break it if they move out. I just need to know if it’s legal for them to move out without paying the rest of the rent because I am selling the house. Thanks for your responses.
the answer is no; they can not break the lease becuase the house is for sale.

one additional word of caution. If they move out, you need to take some care before entering and “regaining possession” of the rental unit.
In short, you need to post a notice of abandonment and intention to enter on the door and wait 24 hrs.
