I manage a mobile home park in NC and we are owner financing the mobile homes to the residents who live in them. Recently I took someone to small claims court (magistrate’s court) and found out that I can’t ask for some of the things we bill the tenant for like their water bill (we figure it just like the town does so don’t make any money on water) and trash. I could only try to collect the lot rent. I also would have to file for foreclosure to collect past money owned to buy the MH.
Does anybody have any suggestions on how I can collect the money the tenant is supposed to pay? Could I do a rent to own including all those fees and then at the end of 2 or 3 years, just declare it owned by the tenant? How can I do varying water bills with this? Before we started charging them for the water they use, we included it in their rent and watched water run down the street. We cut our water bill by $10,000 per month when we started making them accountable.
Any suggestions would be greatly appreciated.
