It seems almost all lenders require a listing agreement when doing a Short Sales. Is their a way around that? Or is it mandatory?

Banks like to know that there is a third party involved that is working to get the borrower as much money as possible which gets the bank more money than they would receive from an investor low balling them. My advice is to seek a Realtor experienced in working with short sales.
I would’t need realtor to do anything but list the property if lender required it. My question was when they ask for listing agreement can you talk your way out of it or is it no questions asked. LIST IT?? I’ve read that you can get away from listing the property if they ask for it. It didnt go into detail so I’m looking for someone who Knows??

Guess what… The MLS rules and regulations state that the “Seller” must authorize the inserting of the property into the MLS…
Here is the million dollar question; Who is the Seller?
Answer; You are, after you have the right to buy the property, as you have equitable interest… Go hire a realtor of your choice and list the property… Sign a "Do not include in the MLS waiver or pend the listing immediately…
Although I didn’t have to have the last SS listed prior to the Lender accepting my offer…

I make sure my short sale request letter discloses “…because of the amount of work needed to the house, I couldn’t find any realtor to list it for me…”
Last week a loss mitigator asked me “…is this the highest offer you’ve received?” I answered “YES”, I didn’t explain anything else, and it got assigned to the closing dep. I guess it depends on the bank.
If they dont approve it, banks are now taking many properties to auctions, you can buy it there cheaper and easier!

Thank you Micheal that helps alot. One question from what you said. If I list it and don’t pend it would the offers that come in be between me and end buyer subject to SS?? Rather than pend, or is that illegal?? Why pend instead of get buyer??
