i sent out my absentee letters and i had an older lady call me who wants to sell fast, she needs the money but its listed with a realtor, can i not make her an offer and put under contract since its listed with a realtor?
Absolutely, my experience has been you’d be best to call the agent and make your offer through him/her.
Reason being if the owner tells them you presented an offer without including them, they’ll very likely come up with a million reasons for the owner NOT to accept your offer.
Offering on listed homes is no different than on unlisted homes it’s still the sa,e procedure, its just a few more headacjes (depemding on the agent)

Either go through the realtor, or ask her to cancel the agreement (in writing) with the agent to avoid paying the commission…some agents will let you cancel it, some wont
Many will go along with a cancellation fee. They don’t have to mess with it any more and it is quick cash. In many cases you can offer the property as a future listing if your rehabbing and pay no cancellation fee.
But alway ask if they will cancel the listing first for the owners benefit first, that the profit margin is skinny already at the price that you can pay and you will have to pass on it, and their client will still be stuck with the house. Many will cancel especially if they have had it for quite awhile, never know.
And they definitely don’t want bad publicity as one broker got when the seller started sending letters to everyone, even door knocked the neighborhood to knock the agent while carrying the for sale sign with scumbags written on it. And and posted his plight every where he could with the agents name and company with the message never use this broker.
Yes you can still make the offer, you just have to make it though the Real Estate Agent. Agents aren’t usually investors best friends, so they can make it a little bit more difficult oppose to you just dealing dierctly with the seller. It all depends on the agent how smoothly the deal goes!

If your not an agent you can make the offer direct, there is no law you can’t go direct, but the agents contract will still be in play.
Since you have already talked to the seller, i think it will be smooth for you even if you go through the listing agent.
