Insurance Premium Refund

I have a little situation i need some advise with.

I have received an insurance premium refund check from the previous insurance company of a house I bought sub2. It is written in the name of the previous owner. Part of the purchase agreement states that we are to receive all these types of refunds including insurance premiums, escrow refunds, etc. I also have a Power of Attorney allowing me to negotiate and receive all these items. Without going back to the previous insurance and trying to explain what I am trying to accomplish, is there a way I can cash this check? Has anyone else run into this problem and what have they done?

Been there, done that…yuou need him (the seller) to endorse the check for you…

I am guessing you mean to sign it to me as a third party check. This particular seller lives out of state and cannot come to the bank and sign it in front of the teller. I am thinking of endorsing it for them as their attorney-in-fact since our agreements state that these refunds are ours. Have you ever heard of doing this?
