I want you experts advice an opinions w/ my problem

My mom died and was letting the landowner where her dw-mh sat on to stay with her for a short while as he had had a stroke. He now put up trespassing signs so we cant get any of her belongings as he’s 80 and kinda crazy. What would you guys do?
We only want her books and so furnishings. Mortgage company says it could take a year to legally remove him from them but I could evict him. How can I evict him if i dont own it?

I went to open probate to be legally in charge even though she had no money only furniture and new tv,dryer and outbuilding.
I am her representative but cant because they had a car in both of their names and until I give county her half of cars value an he refuses to give a penny even though he admits it is half hers he wont and i dont have 1200. just to open probate. help Please!!! :help

I am my dead moms representative , but her unpaid mobile home is on a landowners property who has moved into her mobile home and wont leave or pay mortgage, How can I evict him out of her mobile home that is on his land that he has put up no tresspassing signs? so it can be foreclosed?

Have you been making the space rent payment every month since your mother was incapacitated and passed away?

It only takes 30 days of no payment for a mobile home park owner to be able to legally file for an abandoned Mobile Home title and take legal ownership!

Unfortunately a Mobile Home is registered as a vehicle and as such subject to Motor Vehicle Laws!

Yikes. Because it’s a trailer on someone else’s land … that is an unusual deal. In some states, since you have not legally inherited the trailer yet, you could be legally be shot for trespassing on his land if you snuck over there to try and take your mom’s stuff … so address this situation with care.

I personally would approach the land owner and see what you can do to at least get her valuables that he wouldn’t care about- aka pictures, etc that you guys might want - out of the trailer. And I would avoid removing any of the furniture or the new TV unless he will let you.

You are probably looking at spending $1200 to open probate, and a few thousand dollars more to just to be able to legally force your way into the trailer to remove the stuff. You might even have to move it…which alone would require you to rent or buy land to put it on, and again cost you a few thousand more additional dollars. By then the contents of the trailer would probably be trashed, sold or well used by him.

You should at minimum talk to a lawyer in your state for an hour, and see what they say.

I tried to explain delicately and no one understood so I thought i’d put it out there bluntly.

The landowner never charged her any rent as he dated her years ago and he never wanted her to leave as I have a 100 acres across the road but we didnt know we’d go through this or we’d have moved her mh years ago. What if i open a small claim estate and become her personal representative, then could i evict him and get ther things.? The mtge co says they can evict but their legal process is very slow and he may stay there a year before they actually come to change locks and move it, when they see his no trespassing signs they will leave. I would buy it as a fc but they wouldnt take the 10,000 i offered cash as she owed 28,000 on it. It isnt worth over 10,000 andby the time they have to evict move it set it up, you’d think they’d take 10,000 but tthey said no! I didnt realize he could take it as a landowner, Hopefully not as he never charged her any rent.
