Fake Owner?

Good evening everybody,

Well tonight I had a seller contact me from my marketing and tell me an interesting story. This gentleman (who’s name did not show up on the tax records tied to this property, let’s call him Joe) said that I was contacting his former girlfriend (let’s call her Jane) through my marketing campaign. Joe claims that Jane was misdiagnosed by doctors and suddenly passed away suddenly (I’m guessing within the last 2-3 months) and he has been residing at Jane’s house (her name was the only name in the tax records). Long story short we talked about what he would expect for a cash offer for the house (which was actually a good deal!).

Herein lies the dilemma. I searched the county records online and indeed found a few records of Jane (from her transfer to the deed on the house plus her mortgage document). HOWEVER I found no filing of a death certificate. I also searched the area’s obituaries for her name (and every way you could spell her name in case of errors) and found absolutely nothing.

My question is, what could be the reason for this? (assuming Joe is not lying) How can I verify that Joe is on the deed? I mean he has to be in order for the house to be sold, right? Should I contact my title company?

He said he wants to sell quick and cheap, and when I ran my numbers this deal made financial sense, Help!

Check the county records to see who’s on the deed. Should tell you who’s on the deed.

EDIT: Called him and just asked him, he said that he has not filed Jane’s death with the county yet and there is NO will.

Now, my question is, can this guy be appointed the executor without any will? I feel like there is no light at the end of the tunnel in this deal as it seems that an attorney will most likely be appointed and this guy will be kicked out of the house once probate is settled with this estate.

Why are you wasting your time on this? The guy is a con man, has no right to the house and is trying to trick someone into giving him cash.

“Boyfriend” does not give him any legal standing. If his girlfriend had wanted him to get the house, she would have put his name on the title, or else named him in her will.

Heck, as far as you know, she isn’t even dead. A death does not wait for a “boyfriend” to record it. It would be recorded by the county coroner-- unless the “boyfriend” murdered her and buried the body in the backyard and he’s the only one who knows she is dead.

Come to think of it, I think I’d call the local police and report to the fraud squad that this guy is trying to sell a house that he doesn’t own.
