Evicting tenants

Can someone please help me?
I rented a house to a friend, and because they were in a very bad situation I let them moved into the house without ANY MONEY!!! can you believe this. Well I still believe in some people, anyway, they moved into the house on January 9 and were suppossed to give us the money for the rent on the 13th. I am still waiting for the money and she keep saying tomorrow, tomorrow. Now I am tired of them and want to get them out, but if we didn’t sign anything, so I still have to go thru the eviction process? and if I do, does anyone has a three day notice I can copy from or can suggest any good site where I can find all this type of forms?
I will really appreciate anyones help

You are hereby notified that your rent for the month of March, 2005 in the amount of $500.00 has not been paid plus additional late charges of $ 30.00 are now due. For this reason you and all residents at East 12th Street. must vacate the property within 72 hours or eviction proceedings will be filed. You will also be required to pay an additional $55.00 if eviction is necessary. Please notice this is a serious matter and prompt action is needed

No partial payment will be accepted to stop this eviction process.

I’m afraid that it’s not as easy as using some else’s notice. Eviction laws vary from state to state. This variation includes the length of notice that must be presented, the procedures to follow, and the exact language required in the notice. Therefore, simply copying some else’s notice probably is useless unless they’re from your state and in some instances maybe even your city.

I’d suggest talking to a successful local investor or a local lawyer.

Needless to say - never rent to friends or family. It is not conducive to a long relationship.

Agreed. Ted’s notice can probably be used with a variation, but you should double-check to be sure. Perhaps your local apartment association or investor’s club will have some legal referrals for you.

THANK YOU EVERYONE for your suggestions. I totally agree not to rent to family or friends, but I can help to feel bad about people being on the street, but now I am getting mad, because they are taking advantage of me.
I am in Hesperia, Ca. and I know the requirement is three days notice. What if I go to the court and request a copy, would they have it?

If you own rental property and you have family out in the street, buy them a 500.00 car. Otherwise you could end up on the street.

In CA it’s a little more difficult to evict then the 3 day notice. I am also in CA & am in the process of evicting and it’s a PAIN!!! In my case it’s taken just shy of 4 mos. and it looks like it’ll be finished in another 3 weeks…Good luck.

My rule of thumb is that I never do business with anybody that I can’t sue. I assume I may have to sue them at some point in time. If I do, will it make Christmas, or family reunions or the next party uncomfortable? If it will is the case, I don’t do business of any kind with them. I won’t sell them a car, I won’t buy a car from them, I won’t lease to them, I won’t loan them money. I will, however, give them money, I will give them a car, I will give them a house to live in and I will give them advice. If the unexpected happens (and bad things happen to good people) I may have to sue anybody I do business with. You keep business and personal separate. I was told when I was really young, that you I shouldn’t poop where I eat.

eviction is not a do-it-yourself process (IMHO). Sure you might save a few bucks, but the potential to waste a lot of time is much, much higher. Time is money in the rental business

Thank you aak, I know is better to have someone handle it. I found the forms I needed and I will serve the notice today if they don’t come up with the money I will contact someone to help me.
I don’t want to sound dumb, but what IMHO means?
