Creative way of Evicting

My friends got a property from auction and has ownership of it. The previous owner is still living in the house and is in total denial that the house has been sold. She hasn’t paid the mortgage for 15 months. The eviction process is taken place, just waiting for the court

They guys want to know what the inside looks like to figure out what needs rehabbing.

What are ways to get this woman to let someone in (like a couple of ladies) to persuade her to let us in and take pictures of the inside of the property? Are there any other way? She will be evicted eventually, but I feel it would be better for her to leave on her own rather than a Sheriff come out.

Knock on her door and offer her $1500 to clear out by a certain date. It may be just the $$ she needs to rent somewhere.

Either pay her to leave or wait for the sheriff. There’s no need to expose yourself to liability.

Do you think knocking on her door, offer her a couple of hundred bucks to just take pictures be okay? We were thinking of sending a couple of girls out there who happen to be under 5 feet tall…hehehe, so it wouldn’t be intimidating to the her.

It’s OK up until the point she tells you not to bother her.

How is this not considered trespassing? This lady no longer owns the property and there’s obviously no lease in place that needs to be followed! seems like the new owners are getting SCREWED! I say call the sheriff, why tiptoe around the issue? I wouldn’t pay this bum a dime…

It’s not trespassing because it’s a tenancy at sufferance. The sheriff can’t do anything until there is an eviction order.

She has been sent certified letters from the bank, so she must know what’s happening.

I don’t know about other states, but from my understanding in California, paying her to leave is sort of illegal. But yet the banks are able to do it. :bs

I’m told, she’s a single mother and I do feel for her, which is why I thought we could persuade her to leave, before the court gives the okay to force her out. I doubt that moving cost is why she’s still there. The woman has been living there for free for over a year! I’m sure she has a lil something saved up!

I thought we should just go ahead and knock on her door and just be honest:

Knock, knock!
“Hi, are you Mrs. In Denial ?”
“Yes, my name is In the Know, and I was sent here to let you know that the owner of this home has filed papers to have you removed from this property.”
“No, Mrs. Denial, you no longer own this home.”
“WHY? Well, for starters, you haven’t paid your mortgage company in 15 months.”
“Oh, you’re getting a remodification on your mortgage loan??”
“Well, I’m terribly sorry, but that fell through… Instead, the bank has decided to put your house in an auction at a ridiculously low price, and a sweet old man bought it and would want nothing more than to have you leave so he can finally come in, fix it up nice n pretty, so he can turn around a sell it for a nice profit…then turn around and do it all over again.”
“Mrs. Denial, please get up off the floor and stop crying and let me inside so I can take pictures of the house.”
“Did you say NO?!?!”
“Well fine then!”
“Oh, one more thing. In about 2 days a Sheriff will be here with his entourage to force you out physically. At which, you have 15 minutes to gather your belongings and get out. And if you set foot on this property again, you will be arrested! Then, all of your belongings will now belong to the sweet old man. He then will have a huge garage sale and again profit with YOUR previous belongings on YOUR previous home…and do you know what I think?”

“I think it would suck to be you!”

I would just focus on the eviction and be done with it… too much chance to enflame her and then you could be potentially left with damage to the house that may not have been there… She can always claim that it happened while she “owned” the house…

She can say your lady friends threatened her, and drag it out in a she-said, she-said…

Let the sheriff do his job and be there to document any damage, then put a free ADT wireless security system in place the next day with a monitored smoke detector option… just in case she get vengeful and decides to get “creative”…

Good point Positive! And sometimes these homeowners have dogs and that could be a problem.

They decided to just drive by and out. Everything still looks good from outside, so they just wait for the court.

Btw, I wouldn’t of said those things I posted. That’s just mean. Couldn’t sleep, so I got a little too creative!

I offer a clean house bonus on these. As soon as the Sheriff lets her know about the Eviction let her know that you work in Real Estate and can MAYBEhelp her find a new place. At that point let her know there is also a clean house bonus of up to $2,000.00 they will generally leave the house in better shape. Try to become her friend they won’t trash your house as bad. I have bought them before and the old owner will take EVERYTHING including the kitchen sink (SERIOUSLY) yet when you try to be nice they play along as well. They really play nice when there is CASH invloved. BTW the most I have ever paid out was $1,500 those people washed the windows and everything for me. That house was ready to sell the next day so it was well worth the money. Just my two cents.
