Countrywide Invoked DOSC

John, I only know what I have been told… I have relayed that information as accurately as I could. Why they didn’t apply for hardship is not something I can answer. The approval of the deal I am trying to get done is subject to the underwriters that view it. We had two different underwriters for countrywide view the same file and the first one said it wouldn’t be a problem so we submitted it there. The underwriter who actually had the job of approving the file was in another branch and they didn’t share the same opinion of the underwriter that we consulted with. I am going to check out the VA site and see what I can pull off of there to support my borrowers claims and maybe send it to countrywide if it will make a difference.

Call the VA Regional Office in your area, this is where to start. Explain the situation, I have a feeling CountryWide will listen when they talk.

They will not turn their back on someone who served their country as CountryWide is apparently trying to do.

Just got some more paperwork -
Countrywide denied the loan on these grounds -

  1. They do not lend on properties in LLC, it has to be out of the LLC for 12 months.
  2. He has no mortgage history on the property (he made 3 initial payments then they invoked the DOSC)
  3. IT was not assumed properly through the VA, he did not file the correct paperwork - paperwork that I can not fined referenced anywhere on the net, I combed all through the VA site.

Another point - He has a 2nd on the property it looks (mortgage deed) like for about $30k. He(personally) was the grantee and the grantor was his Corporation not his LLC.

I am willing to guess this might be what actually triggered the DOSC.

In the court findings - My Client is referred to as a non-party to the note and Mortgage, is in further default, as said trasnfer is without prior written consent of the Lender in violation of the terms of the Mortgage specifically section 12. - looking up section 12 of a VA mortgage in CT now…

If they invoked the DOS after he made three payments starting in 2004 this may be one of the longest DOS foreclosures in history. Looks like he holds a second on the property, which will not trigger the DOS or if it does then a whole bunch of homeowners might be in trouble if they believe in the DOS police.
