Does anyone know the process of child support liens on a mortgage, does the money go to directly to the children or does it go to the government???
I’m not sure what you mean. Are you asking how to place a lien on a property for a child support debt? I never tried, but I don’t see why not as long as a judgment is in place. However, a child support lien is junior to a mortgage and can’t force the sale of the property.
In my state, child support is paid to the state and then disbursed to the child’s guardian, usually the custodial parent.
My sister wants to sell me her house, which has a child support lien. Her husband owes back child support. I just want to make sure the money will go to her children and not to the state.
Child support goes to the children. The state doesn’t keep it.
