Can an LLC lend money?

My main question is whether an LLC can lend money to a private party. I was wondering if anyone knows just how this will work out, legally that is?

Yes, just as an individual can lend money to an individual. But you better not charge over 10% total APR or it is usuary and if they sue you they will win, and may not have to pay you back the money, not to mention potential jail time. However, if there is a brokers license or a financial lender’s license associated with the individual or LLC making the loan then you are exempt from the usuary law.

Then there are a bunch of other laws and regulations regarding legal lending.
Best deal with an experienced broker and real estate lawyer in your area before going down that road.
