I just got back from court. Fortunately, I didn’t have any evictions myself, but I was a witness for another landlord.
I got there a little early and had to sit through the 2 prior cases. It must have been amateur hour. One landlord didn’t have a written lease and hadn’t received rent since July. In the other case, the tenant was 3 months behind on rent. Unbelievable!
In the case for which I was a witness, the landlord had shown an apartment to a man and his girl friend. The tenant told the landlord that they didn’t want the apartment, but then broke-in and moved-in their stuff. The landlord didn’t discover this for about a week. She immediately called the police, who said that it was a civil matter and that she must evict them. The “tenant” is a convicted criminal with quite a wrap-sheet. Anyway, to make a long story short, the “tenant” scumbag got evicted! Gpod Riddance!

How long do you usually wait after rent is due to start the eviction? How long do you give the tenants?

The rents are late at 5pm of the 4th. At 5:01 I start posting the 3 day eviction notices.

No signed lease and no keys plus an actual break-in equals a criminal case right? Guess not…damn cops.
I agree, when you go down to small claims court you always come out saying I want to go back there again. It is really entertaining (when you are not on the docket).
I agree the court can be amusing, but for me I get entertained while I meet with the obviously frustrated landlords outside after the case. I hand them my card and tell them that I am interested in buying their property.
At that point they don’t want to be a landlord, so they are motivated sellers.
