I did not ask the right question, disregard that. I take it from what you are saying now that sandwich lease are not right or do not work?

Sandwich Lease - lease held by a lessee (tenant) who becomes a lessor (landlord) by subletting to another lessee (subtenant), typically the sandwich leaseholder is neither the owner nor the user of the property.

The person in the middle of the sandwich lease is the master tenant. He is subletting the property to his tenant/buyer. When the sublessee decides to exercise his option, the master tenant also exercises his option. By the time the tenant/buyer comes to the settlement table, the master tenant owns the property and transfers legal title.

Nothing illegal in sandwich leases as long as the master tenant can deliver clear title when his tenant buyer exercises his option.
