well, it ain’t over till the fat lady sings…in this case…it’s FAT PHYLLIS !!..here’s the latest…closing day came… ( last monday ) without a closing…no a huge surpise to me… i got the execution from the court on thursday ( mailed to me) and with it along with a motion from her atty to " amend the agreement"…so i immediatly had her served with eviction …this motion was filed after the closing day came and went…so i have to go back to court monday, and i have the eviction lined up for monday afternoon…the motion is basically to try to amend the agreement, and extend the closing date…of course, her atty’s throw in the minor children bullcrap…and that we stand to make 2000% profit on the deal…and that she has complied with the agreement …NOT ! …well, in the meantime of all this…i gotta make anothe mortgage payment im not happy about, more time outta work and atty’s fees on top of that…the noose is tightening…i’ll post up on monday after court…or after the eviction ! …hahahh …what a circus !! …

hey all, sorry about the lack of post…was on a well needed vacation for the last 2 weeks…here’s the long and short of it…went to court that monday…she had already been served with the eviction the prior thursday ( monday 2:30 eviction) …PHYLASS was trying to buy more time stating her friend did everything according to our agreement to buy the home ( title search, $4000 deposit, ect…and she stated that we have been in contact with the lender…we explained that it is now 1 week past the closing date…and we are going to remove her at 2:30…her friend can still buy the home if she wants to…but she is out…the clerk told her there is nothing she could do to stop the eviction, i explained to her that i don’t take kindly to people who file false police reports against me and my wife, and that she’s out today no matter what…i told her it has cost me enough money, and she hasn’t paid a dime for occupancy…i told the clerk i don’t care about her ( civil lawsuit ) and told her to tell PHYL-ASS , that she might as well tack on another lawsuit on top of the $400,000 she’s already suing me for…we were leaving on vacation the next day…we came to an agreement…she pay’s us $3000.00 that day out of the escrow money for occupancy…when we get back from vacation, she either closes on the home by that time ( i signed over power of atty ) or she turns in the key’s to my atty…and she can get the remaining $1000 in the escrow for moving expense…( this was so she couldn’t tell the judge that she didn’t have money to move, we also added in the agreement that no futher notice ( 48hr ) need to be given, and no further stay’s of execution. …anyway…we got home from vacation, financing fell thru for her, the key’s weren’t turned in yet ( so we went to our atty’s and collected the remaining $1000 per agreement, …i called the constable, he went over read her the riot act, truck is on the way, ect…well she called the church, and got a bunch of vounteers to help, and she was out by 7:00 last nite, key’s in hand, i was over there, and she was actually mopping and cleaning the kitchen floor, she stated she didn’t want any problems with us or our atty’s ect…and was nice as pie…she’s gotta be bipolar…house is in great shape…have to replace one bedroom carpet, and im gonna put a fresh coat of paint all around, already dropped off alot of stuff to get moving on it today so i can get it on the market…kind of depressing i don’t have any more HORROR stories to tell …LOL…hopefully, we get a quick sell ! thanks all for the support

Your remark about her being nice as pie got me thinking…is there anyway she could file a lien against the title to the home preventing you from selling? Legitimate or not, is it possible?
i don’t think so…she was actually at my atty’s office on wedesday of this week telling them she was going to purchase the home back…what a crock

got it under agreement for 382,000 w/ contingency on selling " their" home…im still able to show it an entertain offers, as long as i give the people a 24 hr notice to buy the home and remove the contigency…only had it on the market for a couple day’s…pretty sure i’ll get a better offer…
Ya know I hate to say it but for all that she’s crazy… Seems to me she’s crazy like fox. I mean let’s assume foreclosure after 90days of non-payment… possibly 180, but let’s go with 90.
So she’s behind on her utilities, hasn’t paid mortgage in 90 days or her taxes for the year…
Then it sells at auction, she refuses to leave and draws out a legal case that lasts effectively another 3 months, during which the new purchaser on her home pays her taxes, and pays her utilities… who she’s also not paying rent to. Seems to me she got a free ride for 6 months.
