I just registered on this site and clicked on this topic. I am from MA and got hooked on this saga like a soap opera. Any judges will want too see you doing the right thing and not being forceful (legally of otherwise) I am new to foreclosure investing and wish you the best…tough situation to be in. Looking forward to reading about a great outcome for you SOON.
Watch a Michael Moore film with the sound turned down, pictures and video don’t lie. Roger and Me was probably one of his best films, and I think it was his first, it showed a booming town go bust. That is what was going on in the 80’s with the U.S. Manufacturing base leaving for Mexico or China. What do we make today? Trac housing that’s all. Don’t shoot the messenger, he didn’t move GM to Mexico, or made Bush attack Iraq.

hey BC… i got the eviction hearing next monday… i did just do an inspection on the 29th…pretty happy with it…house is " still " in perfect condition…just gonna throw some fresh paint up… also, the " former " owner when she was trying to get me to sell the property back to her told me her basement wasn’t finished and ( since it was raining ) she had to get home to make sure the basement wasn’t flooded… well … the basement is finished…with a tv area… 2 bedrooms , and a full bath…that was nice…add’s another 900sq ft, and a full bath on the home…

well, next step is the housing court seeking eviction, they will try to say, you can’t evict her…there is pending civil action in superior court for an illegal foreclosure…i did pull up a similar case where the judge granted eviction, and said " take it up with the bank that foreclosed" hopefully it’ll be a similar result…2nd case scenerio would be the judge saying…she can stay until the civil action is cleared up …BUT …you must pay for occupancy (which im seeking $2900.00 per month ( from dec 1 ) …3rd scenerio would be the judge saying she can stay there for nothing, and we have to pay the bills and the mortgage… i don’t see that happening… got my fingers’ crossed for eviction , im sure she’ll appeal…i just want to get in, paint , maybe carpets, and be done with it, i’ll keep ya’s posted…
That sure is worse case, The Freebie Deal.
Unlikely because the judge would also look at your interest as well and the damage this could cost to your finances and credit.

I’m thinking the judge lets her stay until the civil action is cleared but she has to pay$ to stay.
Well, I am keeping my eye on the e-mail for updates…
talked to my atty today that’s representing me in the " civil " action for illegal foreclosure…he talked to the atty’s representing countrywide ( the other defendent’s in the suit " any way…they said that the auction was cancelled the first time, because she had a buyer with a signed p&s…so they put it off …well, she went to the office with a p&s for $100,000 less than she owed the bank ??? ???, they told her to beat it…well, if she was trying to buy more time…she did it…anyway…before the final auction, she calls them again…with the same story…she’s got a p&s signed…they told her to get to the auction…guess what …it’s the same one…so they proceeded…what a piece of work…anyway…they assured me that everything was done precicely by the books…when the " housing court judge " hears all this… i mean… he’s gotta evict?? … im gonna talk to my atty. tomorrow who’s representing me in the " housing court matter" for eviction…Only a few day’s away now… anyone who’s been following this thread, i’ll keep ya’s all posted…thanks for the ongoing support in this saga … ;),

oh its a saga alright…I don’t think the courts take kindly to people trying to be cute with the rules (same p&s???) nice try lady…get out!
oh boy , what a doozy…my atty talked to her atty today…and her atty said, we’ll make you an offer…
he said, our offer is to let her stay in the property for 3 months , rent free, and then at the end of the 3 months, you give her $1000.00 for her " new apartment " …this lady is unbelievable…good thing is …it soundls like she still has no idea we know about her 3 family home she owns…im gonna call my atty back tomorrow with a " counter offer " …pay me the $4000 you owe me, get out now, and i won’t attatch a lien on your property…can you believe this lady,… she seems to forget i paid the $6000 in back taxes she owed…eviction hearing on monday…more to come … im sure of that…
. ???..and the hits just keep on coming. keep the faith…sounds like its time to turn the heat up a bit(via your atty) and move this thing along good luck on Mon.

and it keeps gettin better…ok…we put the pressure on her…we told her about attatching a lein on her other property, have proof and afidavid from countrywide, and copies of her fraudulent p agreements showing she new of the foreclosure…she came back with the offer above…3 months rent free, and she want’s $1000.00 to move… on the advice of 3 atty’s…they said the smart thing to do would be negoicate, save all the atty’s fee, and civil action and be done with it…so i came back with an offer…leave by jan 30, and we’ll give $1000.00 moving expenses, and she’ll drop the civil action… wait…it gets better…so my atty call’s her with " our terms " …she say’s …NO WAY… i am not leaving this house, i don’t want to leave… im obtaining a mortgage, and im offering them 375,000 for the house…lol…so my atty’s said, draw up an offer… i’ll give it to my client…but we are proceeding full steam ahead, see you in court monday…it’s comical…this lady is bonkers…my atty also told them …if they have anything more to say…put it in writing,…nothing can be believed coming out of their camp…so…monday’s on…im telling ya…i just starting choking i was laughin so hard when i heard this…it’s the first time i laughted over this thing since it started…keep ya posted

New to the site. Been reading about this “kooooK” ::). I wish you the best. Sounds like you shouldn’t have a problem evicting her…but then again, she’s a couple sandwiches short of a picnic and sometimes you really can’t tell to what extent they’ll take this to, hopefully there’s not another tier to this mess.

well when you buy foreclosures, if someone is in the unit…you should away’s factor in the cost of a long dragged out battle into your " bidding " price…which i did…only problem here, is the civil case she filed , which , changes everything, …no one seems to know what effect the housing court * eviction * case will have with the pending " civil litigation " …because it’s a rare bird when this happens…but i did make an offer to her to get out, buying her time, and putting a few bucks in her pocket…which was a a killer…because i don’t like to hand out money to people who file false police complaints, try to get me arrested, and generally set a bad example for their kids…but it was a " business decision " and im trying not to get my emotions of this case into it…but…she refuses to leave, she wants her house…im sure at this point, after seeing the answers to the complaint from myself and countrywide…her atty’s told her she don’t have a leg to stand on…hopefully this is over soon, cause i really need to flip this thing and free up some cash, and hop in to another deal…
It sounds like you’re doing this right. Do you think knowing there was going to be a fight from this lady from the beginning that you perhaps you should have let this one slide :-? Keep us posted.
well, i didn’t know this was going to be a fight…but if someones in the home…it’s best to assume that you are going to have some extra cost with eviction, and carrying cost for the time it takes them to get out… i should still clear a nice profit when it’s done…it only needs some paint ( some nuetral colors ), and maybe some carpet…its it’s up for sale
